(MandyNews.com) – Rapper Tory Lanez, who was recently convicted of shooting fellow artist Megan Thee Stallion, is fighting to have his conviction overturned, according to legal documents obtained by TMZ.
Jose Baez, a well-known criminal defense lawyer and Lanez’s lawyer, has filed an appeal, saying that the prosecutor did not do their job right and that irrelevant evidence was used during the trial.
One of the key pieces of evidence called into question by Baez is a shirtless photo of Lanez with a firearm on his chest. The prosecutors said that the photo was shown so that Lanez could be identified, but Baez says that it was used to make the jury think that Lanez liked guns, which made him look bad.
This, Baez contends, was an improper use of the evidence.
The appeal also highlights other instances in which the defense alleges prosecutorial misconduct. Baez claims that it was inappropriate for prosecutors to threaten to present Lanez’s rap lyrics to the jury, as they could have been used to create a biased view of the rapper’s character.
Additionally, Baez points to an 80-minute interview with Kelsey Harris, Megan Thee Stallion’s friend, who was present in the car during the night of the shooting. The audio of the interview, which was damaging to Lanez’s case, was played for the jury.
However, Harris later recanted a significant portion of her statements made during the interview. Baez argues that the recantation should have been considered and the jury should have been made aware of the inconsistencies in Harris’s testimony.
The appeal also questions whether an Instagram post with a comment from one of Megan Thee Stallion’s producers should be allowed to be shown in court.
The producer claimed that police had matched bullets from Lanez’s gun to the fragments found in Megan’s foot.
Baez says that it was wrong to let this piece of evidence in because it could have swayed the jury’s decision.
Baez also questions whether Megan Thee Stallion’s statements to police should be used as evidence in the trial.
In her statements, Megan claimed that Lanez pleaded with her not to say anything about the shooting because he was on probation. Baez says that these things shouldn’t have been said because they might have made the jury think less of Lanez.
Tory Lanez is currently facing 22 years in prison for three felony firearms violations. His sentencing is scheduled for next month. The outcome of the appeal remains uncertain, but the case has attracted significant attention in the entertainment industry and beyond.
